WILMINGTON, N.C. (AP) — A Wilmington man convicted in a 1988 death wants his case overturned.
The StarNews of Wilmington reports (http://bit.ly/29LPeay) that Johnny Small has made the request after a key witness against him has recanted his testimony.
Small was 16 when he was convicted in 1989 for the death of 32-year-old pet shop owner Pamela Dreher.
Police say Dreher died from a single gunshot wound to the head. The autopsy said the gun was pressed against her head when she was shot.
Lawyers with the North Caronia Center for Actual Innocence said a key witness called them in 2012 and said he provided false testimony against Small.
The center submitted a request for the overturning of the conviction last year. Small’s request is scheduled to be heard Aug. 8.
